Purchases of Copenhagen Blinds from Art Andersen CPH ApS can only be done online at byArtAndersenCPH.com

Articles purchased through byArtAndersenCPH.com are delivered to the delivery address specified on the order confirmation.

 

Placing an order

When shopping on byArtAndersenCPH.com, you will need to state your name, address, telephone number and email address. You must also fill in credit card information. Once you have accepted the terms and conditions and you proceed, your order has binding effect and you carry out the payment.

PLEASE NOTE: Orders for Copenhagen Blinds are based on customized measurements and CANNOT be cancelled or changed.
Change requests must ALWAYS be notified by email to copenhagenblinds@artandersencph.com and a new order must subsequently be
confirmed by Art Andersen CPH by email in order to be applicable.

Once you have completed the payment, you will receive an automatically generated order confirmation by email.

Not until the order is ready for dispatch here in Denmark, will we draw the agreed amount on your payment card – and you will receive a notification of the delivery time as well as the final invoice by email.

We recommend our customers to print out the invoice immediately after receipt, as the invoice may be relevant in connection with replacement, cancellation or complaint.

If you order only standard articles, which are not made to measure, the automatically generated order confirmation is also a legally binding
order confirmation.

3. Measurement, design and materials selection

The measurements stated are always meant as the final measurements of the products. The measurements are always stated in millimetres and in the order width x height.

At Art Andersen CPH, we are continuously developing our products. We therefore reserve the right, at any point in time and without warning,
to change the design and shape of our products as well as to change the materials selection. Ordered articles will always be produced in
accordance with the standards in effect at any time for Art Andersen CPH production at the ordering time in question. Articles ordered at
different points in time are therefore not necessarily fabricated according to the same guidelines and are therefore not necessarily
identical.

4. Delivery

Copenhagen Blinds purchased through byArtAndersenCPH.com are delivered by GLS Express A/S or another courier service to the delivery address specified on the order confirmation.

Costs for delivery in Denmark are included in the price stated on byArtAndersenCPH.com, and it is Art Andersen CPH who decides the
delivery method.

There may be an extra charge for delivery according to other countries of delivery, and the specific charge will be will be shown during the ordering process.

It is important that you are present at the time of delivery. The courier service will contact you approximately half an hour before delivery – at the phone number that you stated when ordering. If you are not at home and the courier service is unable to deliver your order, the carrier will take back the parcel. The carrier will put a note in your mailbox with contact information so that you may call and schedule a new
delivery time. If it is not possible to deliver your order the second time, your order will be returned to Art Andersen CPH's storage facilities in Denmark. All costs related to re-shipment of the order shall be paid in advance by the buyer.

We only deliver to addresses within the EU.

 

5. Delivery time

The estimated delivery time will be specified in the order confirmation. Art Andersen CPH Copenhagen Blinds are manufactured especially for you according to the desired measurements. That is why the delivery time can only be an approximate time.

In case your order also includes standard accessories from stock, your combined order will be delivered once all articles are ready for
delivery.

If your order is going to be delayed, Art Andersen CPH will inform you of this by email as soon as possible.

Reservations: In any case, the buyer cannot demand a compensation larger than what is equivalent to the value of the purchased product.

6. Complaints

The regulations on defects as stipulated in The Danish Sale of Goods Act may apply to purchases of goods.

All deliveries are packed by hand by our sub-contractor, and during that process the articles are checked for flaws and defects before dispatch.

When you shop on byArtAndersenCPH.com you have a two-year warranty. This means that if you receive a defective product, the article(s) will either be repaired or replaced at the choice of by Art Andersen CPH.

It is, of course, a requirement that the complaint is justified and that the defect did not arise as a result of misapplication of the product or
other wrongful behaviour.

 

How soon should a complaint be filed?

You must file a complaint within reasonable time after you discovered the defect of the article. If you file a complaint within two months after
the defect was discovered, the complaint will always be in time.

In case the complaint is justified, we will, of course, refund your (reasonable) freight costs.

Complaints must be sent to copenhagenblinds@artandersencph.com or by use of the cancellation form at the end of this document.

7. Right of cancellation

Right of cancellation of purchase of custom-made articles (Copenhagen Blinds): When purchasing articles online, a private individual (a consumer) usually has 14 days’ right of cancellation. The present terms and conditions derogate from this basis for the following reasons: Orders on custom-made articles placed with Art Andersen CPH on byArtAndersenCPH.com are custom-made to the buyer's individual wishes
and needs in accordance with the specifications and special dimensions stated by the buyer. Buyers of products from Art Andersen CPH accept for the above reason that the right of cancellation shall lapse.

In order to respond to any errors and misunderstandings, Art Andersen CPH, however, gives the buyer the option of cancelling the purchase up to 24 hours after placing an order on byArtAndersenCPH.com.

 

Right of cancellation of purchase of accessories/stock items (accessories
for Copenhagen Blinds):

The usual 14 days’ right of cancellation for private individuals purchasing articles online applies only to products not custom-designed
for the customer in question. The right of cancellation shall run from the date on which the article is received.

The right of cancellation does not mean that you have an absolute right of receiving reimbursement for the full amount paid for the article. If
the article has been handled in such a way that it has no value, you will not be entitled to receive reimbursement for the purchase price. In
order to receive reimbursement for the full purchase price, the article may only be used to the same degree as is accepted before purchase in a regular physical store. Before sending back an article, you must therefore decide if a regular shop would accept the degree of use which
the article has been exposed to. This means you have the right to make an assessment of the article and try out some features. However, the refund will be reduced if the article has been used for a prolonged period of time or if it shows any signs of wear.

The original packaging may be a significant part of the article's value, for which reason we recommend that you send back the original packaging along with the article. Missing original packaging most often leads to a decrease in sales value which is why an amount equal to the decrease will be credited based on an assessment carried out by Art Andersen CPH.

If you wish to make use of your 14-days’ right of cancellation, you must notify us within 14 days after the day on which you received the article. The notification may be given in the form of an unambiguous statement by email to: Copenhagenblinds@artandersencph.com

Should you cancel your purchase and should you wish to make use of your right of cancellation, the article(s) must be sent to Art Andersen CPH's storage facilities: Art Andersen CPH, Fabriksvej 4, DK-9640 Farsø, Denmark, no later than 14 days after we have received your unambiguous statement that you wish to avail of your right of cancellation.

You cannot cancel the purchase by denying receipt of the article(s).

You are solely responsible that the article(s) is/are returned to us in an intact condition.

The costs of returning the article(s) in the event of cancellation rest with you as the consumer. Any costs incurred by Art Andersen CPH in
connection with your refusal of receipt of the article(s) will be deducted from the amount credited by Art Andersen CPH in connection with
the return of the article(s) to Art Andersen CPH.

 

Reimbursement of the purchase amount

Should you regret your purchase, you will, of course, be reimbursed the amount you paid to us once we have received the returned article(s) and we have verified that it/they conform(s) to the rules of cancellation. We conduct such a reimbursement using the same method of payment that you used for the original transaction unless you have explicitly agreed otherwise. The only costs you have, should you choose to cancel the purchase, are freight costs for sending back the article(s) to us. Please note! We do not accept packages sent cash on delivery.

We may withhold the reimbursement until we have received the returned article(s) unless you provide us with evidence before that time that you have indeed returned it/them. In case you paid by Mastercard (Mastercard Debit)/Visa Electron and want to cancel your purchase, the amount will be reserved on your card for up to 30 days, even though we, on our part, cancelled your reservation.
This has nothing to do with Art Andersen CPH.

8. Art Andersen CPH data registration

When you place an order with us, you must state your name, address, telephone number and email address.

We need this information, on the one hand, in order to be able to keep you informed about your order and, on the other hand, in order to be
able to deliver the article(s) to you. The information is not transmitted in encrypted form and is not stored in an encrypted state.

All the information that we register will be treated confidentially and in accordance with the Danish Data Protection Act. According to the Danish Act on Bookkeeping, we store this information for 5 years.

The information will not be sold, transferred or otherwise disposed of to a third party. As a registered buyer, you always have the right to and option of insight, just as you can object to a registration. In case of questions, you are always welcome to write or call us.

When personal data is collected via our website, we ensure that this always happens by giving your explicit consent so that you are informed of exactly what information is being collected and why.

Your information can be accessed by employees at Art Andersen CPH and is used only to process your order.

Your information is sent to our subcontractor who produces and packages your order.

Art Andersen CPH ApS is the data controller.

9. Force majeure

Art Andersen CPH is entitled to cancel orders or postpone an agreed delivery of products and cannot be held responsible for any missing, defective or delayed delivery due to, in whole or in part, circumstances
outside of Art Andersen CPH’s reasonable control options, such as uprising, unrest, war, terrorism, fire, public regulations, strike, lockout, slowdown, lack of transport means, commodity shortages, illness
or delay or shortcomings in deliveries from the supplier, failures in production or testing or lack of energy supply. In such cases, all the buyer's powers are suspended or will lapse. Neither in case of cancellation nor in case of deferred execution can the buyer demand compensation or make any other demands against Art Andersen CPH. The above disclaimer applies unless otherwise provided by the mandatory rules of Danish law.

10. Children and adolescents under 18 years of age

You must be at least 18 years of age in order to shop on byArtAndersenCPH.com – if you are under 18 years of age, you must have consent from your parents.

11. Price formation

All pricing includes VAT and other taxes. Prices are current prices. During the purchase process, the total amount will be displayed continuously in the shopping cart.

Art Andersen CPH is not liable for charges or any other fees and expenses charged by the tax and customs authorities in the recipient country or otherwise caused by the product ordered being sent to the recipient country, and you are therefore liable for payment thereof.

12. Your payment and payment safety

Data submitted by you in connection with purchases paid by a payment card are encrypted (SSL) and thus readable only to NETS/DIBS.

The amount is reserved, but the money will only be drawn once your order
is sent from Art Andersen CPH in Denmark.

An amount larger than the amount approved by you when placing the order cannot be drawn.

On www.byArtAndersenCPH.com you can pay by:

byArtAndersenCPH.com complies with NETS's guidelines for internet commerce. This means that you, as a consumer, are at least as well situated as when you pay by your payment card at your local supermarket. Our payment module DIBS is registered and approved with NETS.

Please note! In case you paid with Mastercard (Mastercard Debit)/Visa Electron/JCB, Diners Club or American Express, the amount will be reserved on your card for up to 30 days. even though we, on our part,
cancelled your reservation. This has nothing to do with Art Andersen CPH Copenhagen Blinds. If necessary, you may contact your bank and ask them to cancel the reservation.

13. Invalidity – partial validity

If any part of these terms and conditions should be considered unlawful and invalid and thus not enforceable, this will not affect the validity and enforceability of the remainder of these terms and conditions.

14. Complaint handling procedure

If you want to complain about your purchase, you must contact Art Andersen CPH ApS via support@artandersencph.com.

A complaint about one or more article(s) or service(s) purchased from us may be submitted to the Danish Competition and Consumer Authority's

Consumer Complaints Board, Carl Jacobsens Vej 35, DK-2500 Valby. You can file a complaint to the Consumer Complaints Board on www.forbrug.dk.

Furthermore, the EU Commission's online complaint portal can be used for the filing of a complaint. This is particularly relevant if you are a consumer residing in another EU country. The complaint, if any, is
submitted here: http://ec.europa.eu/odr. When filing a complaint, you must state our email address: support@ArtAndersenCPH.com.

If we do not succeed in finding a solution, you can file a complaint with the Danish Consumer Complaints Board if the relevant conditions are met:

15. Governing law and jurisdiction

Any orders placed and these conditions will be governed by and construed in accordance with the laws of Denmark and will be deemed to have occurred in Denmark. You agree, as we do, to submit to the non-exclusive jurisdiction of the Danish courts.

Your statutory rights are not affected by these terms and conditions.
